Trademark registration in India, just like all the legal licenses, has an expiry. Trademark registration expires after 10 years India. Once your trademark registration expires, you lose the right to use the trademark as your own. But, don’t worry, you can keep it permanent by filing a trademark renewal application online or offline by paying necessary renewal fees every 10 years. The application has to be filed on or before 6 months from the date of expiration of the TM registration.

  • It allows the attorney to file the TM renewal application on your behalf with the trademark registry
  • Copy of TM-A

Trademark Renewal Process in India

Before knowing the process of trademark renewal, we are going to tell you that there are 2 kind of trademark renewal i.e.

  • Application of Renewal made with alteration and change of sign or logo of the registered trademark.
  • Application made without any change of registered trademark.

And now the process is:

  1. Firstly, file an application for renewal is in the form of TM-R.
  2. The application can be filed by either the registered trademark owner or by an authorized representative or an agent.
  3. After filing the Trademark Renewal application, check the status of your application periodically until it is processed by the registrar.
  4. When the application is approved; the trademark will be published in the official gazette i.e. the Trademark Journal. Therefore, trademark renewal process should begin 3 to 6 months before the expiry of the trademark.
  5. For requisite fees Form-18 is used to file with the application.
